Terms of Service

Please read these Terms of Service ("Terms") carefully before using WhisperLover ("the Service", "we", "our", or "us"). By accessing or using the Service, you confirm that you are at least 18 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you may not use the Service.

The Service is intended for entertainment purposes only. It is not a substitute for professional emotional, psychological, or therapeutic support. AI characters are entirely fictional and cannot form real relationships, fulfill real-world promises, or possess genuine emotions.

1. Eligibility and Account

1.1 Age Requirement

You must be at least 18 years of age — or the age of legal majority in your jurisdiction, whichever is higher — to use the Service. By registering, you represent and warrant that you meet this requirement. We reserve the right to require additional age verification at any time. Accounts found to belong to minors will be immediately terminated.

1.2 Account Registration

You may register using Google OAuth or an email and password. You are responsible for providing accurate and complete information and for keeping your account details up to date. You are solely responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials. You agree to notify us immediately of any unauthorized use of your account.

1.3 Account Ownership

Accounts are personal and non-transferable. You acknowledge that you have no ownership or property interest in your account. We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

1.4 User Safety

We strongly advise you not to share sensitive personal information — such as your real name, home address, financial details, or identification documents — in AI conversations. If you encounter content or behavior on the platform that you believe violates these Terms or poses a safety concern, please report it via the in-app reporting feature or by contacting [email protected].

2. Subscriptions and Credits

2.1 Free Tier

Free accounts are subject to daily message limits, conversation limits, and restricted access to certain features and AI models as outlined in our subscription tier table. Free image generation credits reset on a rolling 30-day basis.

2.2 Paid Subscriptions

Paid subscription plans (Basic, Standard, Premium) are billed on a recurring monthly basis through our subscription payment processor. By subscribing, you authorize us to charge your payment method automatically at the start of each billing period until you cancel. Subscription fees are disclosed at the time of purchase and are subject to change with reasonable notice.

2.3 Credit Packs

One-time credit packs may be purchased via cryptocurrency payment. Credits are used for image generation and other premium features. Credits are non-transferable between accounts and cannot be exchanged for cash.

2.4 Auto-Renewal and Cancellation

Subscriptions renew automatically unless you cancel before the end of the current billing period. You may cancel at any time through your account settings. Upon cancellation, your subscription remains active until the end of the paid period, after which your account reverts to the free tier. Any unused subscription benefits do not carry over.

2.5 Credit Expiry

Unused monthly image credits allocated as part of a subscription plan expire at the end of each billing cycle and do not roll over. Purchased credit pack balances do not expire while your account remains active.

2.6 Plan Changes

Upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle.

3. Refund Policy

3.1 Subscriptions (General)

Subscription payments are eligible for a refund only if requested within 24 hours of the charge and fewer than 50 messages have been sent during that billing period. Refunds are not available for technical issues caused by the user's own device, browser, or internet connection. Chargebacks or payment disputes will result in immediate account suspension.

3.2 Credit Packs

Credit pack purchases are eligible for a refund only if requested within 24 hours of purchase and no credits have been used. Once any credits from a pack have been consumed, the purchase is non-refundable.

3.3 EU and UK Consumers

If you are a consumer in the European Union or United Kingdom, you have a statutory right to withdraw from a purchase within 14 days of the transaction date, unless the Service has already been fully performed with your prior consent and acknowledgment that you lose your withdrawal right upon full performance. For subscription renewals, the 14-day withdrawal right does not apply. To exercise your withdrawal right, contact us at [email protected]. Refunds will be processed within 14 days via your original payment method.

3.4 No Refunds for Policy Violations

No refunds will be issued for account suspensions, terminations, content removals, or access restrictions resulting from violations of these Terms or our content policies.

4. Content Policy

4.1 Permitted Content

Lawful adult content is permitted for paying users aged 18 and over who have explicitly enabled NSFW content in their account settings. All AI characters and scenarios are entirely fictional. No real persons are depicted or referenced.

4.2 Prohibited Content

The following content is strictly prohibited and will not be tolerated:

  • Any content depicting, referencing, or suggesting minors in a sexual or romantic context
  • Content that depicts, glorifies, or encourages real-world violence or harm
  • Non-consensual scenarios presented approvingly or without clear fictional framing
  • Harassment, hate speech, or discriminatory content targeting individuals or groups
  • Content that impersonates real, identifiable persons without their consent
  • Content that promotes or facilitates illegal activities
  • Attempts to extract harmful information through AI conversations
  • Spam, automated access, or scraping of the platform

4.3 CSAM Zero-Tolerance Policy

We have an absolute zero-tolerance policy for child sexual abuse material (CSAM). Any detected attempt to generate, share, or solicit CSAM will result in immediate and permanent account termination, preservation of relevant data, and mandatory reporting to the National Center for Missing & Exploited Children (NCMEC) and applicable law enforcement authorities.

4.4 Content Moderation

We employ both automated and, where necessary, human review processes to detect content that violates these Terms. We reserve the right to remove any content, restrict access, or terminate accounts for violations. Moderation decisions are made at our sole discretion. Repeated or severe violations may result in permanent bans without prior warning or refund.

4.5 AI Output Disclaimer

AI-generated responses are produced by large language models and may not always be accurate, original, or appropriate. We may apply filters or modifications to requests before generating output. We make no guarantees regarding the quality, accuracy, or suitability of AI-generated content. You are solely responsible for how you use and interpret AI responses.

5. User-Generated Content

5.1 Your Content

You retain intellectual property ownership of any original content you create on the platform, including custom AI character profiles, descriptions, and personas. By submitting content to the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to store, display, and use that content solely for the purpose of operating and providing the Service.

5.2 Public Characters

If you choose to publish a character publicly, it will be visible to other users on the platform. You are solely responsible for ensuring that your publicly shared characters comply with these Terms and all applicable laws. We reserve the right to remove or restrict the visibility of any character at our sole discretion.

5.3 Creator Economy

The platform allows users to receive tips from other users for their public characters. Tip transactions are final and non-refundable. We reserve the right to modify or discontinue creator economy features at any time.

6. Intellectual Property

The Service, including its technology, design, interfaces, logos, software, and original content, is owned by or licensed to WhisperLover and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license terminates automatically upon any violation of these Terms.

You may not reproduce, modify, distribute, reverse-engineer, decompile, or create derivative works from any part of the Service without our prior written consent.

7. Prohibited Conduct

In addition to the content restrictions above, you agree not to:

  • Circumvent, disable, or interfere with security features of the Service
  • Access or attempt to access accounts, systems, or data that are not yours
  • Use automated tools (bots, scrapers, crawlers) to access the Service
  • Attempt to overload, disrupt, or degrade the performance of the Service
  • Use the Service to conduct or facilitate illegal activities
  • Misrepresent your identity or affiliation with any person or entity
  • Sell, transfer, or sublicense your account or access to others
  • Remove or alter any copyright, trademark, or other proprietary notices

8. Third-Party Services

The Service integrates with third-party services for payments, AI processing, and other functions. These services have their own terms of service and privacy policies, which you are subject to when using those integrations. We are not responsible for the practices, availability, or content of third-party services. Any costs or issues arising from third-party platforms are your own responsibility.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As-Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHISPERLOVER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9.3 AI Interaction Disclaimer

We are not responsible for any decisions you make, actions you take, or consequences you experience as a result of your interactions with AI characters. AI-generated content is for entertainment only and should not be relied upon for real-world decisions.

10. Account Termination

You may delete your account at any time through your account settings. We may suspend or permanently terminate your account at any time, with or without prior notice, for violations of these Terms, fraudulent activity, legal obligations, or any other reason at our sole discretion. Upon termination, your right to access the Service ceases immediately. We are not obligated to provide refunds upon termination for cause. Data deletion following account closure is governed by our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of the jurisdiction in which we operate.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

13. Miscellaneous

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and WhisperLover regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
